Website getting sued for a claimed ADA violation

Hey everyone,

One of our companies (website) has had a civil claim brought against it for a claimed ADA violation.

It appears we have been targeted by a law firm that has made these cases its primary income source. (They had 7 similar cases go out on the same days of ours)

The basic premise of the lawsuit is as follows.

  1. Plaintiff is blind
  2. Plaintiff claims they tried to purchase X product off our site and couldn’t because the site is not setup suitably for blind people
  3. Claim is made under the Americans with Disabilities Act that we have discriminated against plaintiff
We have actually looked through analytics and the product they claim they attempted to purchase was actually out of stock on the days they supposedly tried to purchase. But that is beside the point.

Lawsuit is in New York.

Does anyone have any experience with these cases? Any tips or recommendations for legal representation?

We have spoken to a couple of lawyers. They all basically want us to settle. $6k - $10k to settle + around $4k for them.

Its an absolute racket. Don’t ask me how you are supposed to make a website compliant
